Terms and Conditions (“Terms”)

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://ohiofamilypuppies.com website operated by Ohio Family Puppies (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By adopting a puppy from us, and/or accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, you may not adopt a puppy or otherwise access the Service.

Puppy Purchase Terms

Dog/Puppy Care

By purchasing a puppy from us, you affirm that you:

  • A) Have adequate food & water for your pup, & a warm, dry place for it to sleep.
  • B) Have ample room for your pup to run and exercise. 
  • C) Are committed to the long-term quality care of your dog. 
  • D) Are financially able to cover the costs associated with dog ownership, including vet bills, training, food, etc.

OFP 72-Hour Health Guarantee 

We guarantee your puppy to be free of all communicable diseases for a period of 72 Hours after leaving our kennels. Within 72 hours the owner must take their pup to a licensed veterinarian for an exam. If the vet determines, within the 72 hours, that the puppy needs treatment, or has died from injuries or illnesses likely to have been contracted on or before the date of pickup, the owner is entitled to choose one of our Claim Options below.

One Year Genetic Health Guarantee

We further guarantee the puppy named on this agreement to the original owner against debilitating or life-threatening hereditary/congenital conditions for One Year from DOB, or Two Years with the use of Life’s Abundance food/supplements. (detailed below)

24 Mo Health Guarantee with Life’s Abundance

  •  With the purchase of our Life’s Abundance food and/or nutritional supplements, this Health Guarantee is upgraded to another twelve months from the puppy’s DOB, for a total of Two Years.
  • In order to receive the extra twelve months credit, purchaser must sign up to receive Life’s Abundance’s food and/or supplements on autoship, and feed it regularly to their new puppy, for the duration of the Health Guarantee, or  from the birth-date of the puppy on this agreement. 

Claim Options:

In the event of a claim, the owner has the following options, subject to the Claim Terms below:

  • Return the puppy for a full refund Less any vet or other bills already reimbursed
  • Return & exchange the puppy for a similar replacement pup
  • Receive reimbursement for reasonable veterinary fees, not to exceed the original purchase price

Health Guarantee Claim Terms

Claims on our Health Guarantee are subject to the following Terms:

  • You must provide a written diagnosis with treatment costs from a licensed veterinarian. We reserve the right to have our own vet make or confirm a diagnosis and perform any needed treatment.
  • Ohio Family Puppies is not liable for any costs relating to the puppy after it leaves our premises, including, but not limited to, vet bills, travel, etc. in connection to the diagnosis of any health conditions covered under this Health Guarantee.
  • We reserve the right to refuse a refund if any of these conditions are not met, and any offers of partial, or full refund, reimbursement, or replacement will be issued only at our sole discretion.
  • Puppies sold “as is”, or with known genetic defects at the time of sale, and/or sold as “Pets”, but used for show or breeding purposes, are not eligible for this Guarantee.
  • It’s the owner’s responsibility, to ensure precautions are taken against parvo, and other common diseases, including keeping the puppy off the ground and away from public spaces, until it has had at least its third vaccination and is well established into its new home.
  • In the event of a confirmed claim, you have the options as outlined above. 

Not Covered By Our Health Guarantee

  • Outside the 3 day window, this Health Guarantee does Not cover normal, treatable and/ or other non-life threatening conditions. (Fleas, parasites, ear mites, coccidia, etc.) Communicable diseases, specifically, parvo, Are Not Covered by our Health Guarantee.
  • Abuse: Any evidence of neglect and/ or abuse of the puppy will automatically void all warranties/guarantees, and may result in action on our part to remove dogs purchased from us, from such an environment, at the owner’s expense.
  • PARVOVIRUS WARNING: It is the owner’s responsibility, to ensure precautions are taken against parvo, and other diseases, including keeping the puppy off the ground and away from public spaces, until it has had at least its third vaccination and is well established into its new home.

Puppy Payments & Refund Terms

Sales Terms

All sales are final. No Cash Refunds are given after the puppy has left our kennels, except as part of a claim as outlined in our Health Guarantee, OR at our sole discretion.

Deposits

We require a nonrefundable deposit* to reserve a puppy in your name. If you change your mind regarding a puppy after a deposit has been placed, deposits can be “rolled forward” to another puppy or litter, for a period of Six Months from the original deposit date, after which your deposit will expire.

Note: The final purchase price will not be rolled forward. For example, if you place a deposit on a puppy that’s on sale, but you change your mind, the final purchase price will be the current price of the new litter or puppy, not the sale price of the original puppy.

*Deposit amounts for puppies are non-refundable with the following exception:

  • If your puppy becomes sick, dies, or is unavailable for any other reason, you will be given the opportunity to choose another similar puppy from the same or another available litter, or a full refund.

Final Payments Policy

Full payment of the puppy is required before the puppy leaves our kennels. We accept most major forms of payment, including cash, checks, Venmo, Cashapp, PayPal and major credit cards. PayPal and credit/debit cards are charged an additional 3.5% processing fee.

Taxes and Fees

Ohio sales tax of 7.25%  will be added to the listed price of the puppy when purchasing from Ohio Family Puppies.

Fees we may assess is a 3.5% processing fee (when using card or PayPal for payments) and boarding fees when the puppy exceeds the 3 day allowance for pickup after the listed pickup date. (Current Rate $15/day or $100/week).

Additional Kennel Policies

Puppy Choosing For Litters 

Clients choose their puppy in the order we receive the deposits. Choosing timing can vary but normally when the puppies are 5-6 weeks of age. We will make the arrangements when the time comes.

In-Person Visits / Puppy Choosing

Puppy Pickup 

All adopted puppies are due to go home once they are a minimum of eight weeks old and have a clean bill of health from our vet. You will be notified in advance to arrange pickup/delivery options.

Boarding

On request, we will board your chosen puppy as long as needed, at a rate of $100/week or $15/day, starting the 5th day after regular scheduled pickup was due.

Pick of the litter 

We always retain the right to first pick of every litter, unless expressly noted otherwise.

Availability

We do our best to honor personality, gender, size, and color preferences, but availability is not guaranteed.

Pricing

Pricing is as marked on the website by each puppy/litter. Occasionally, individual puppies within a litter are priced differently, depending on their color/markings and other factors. We price our pups based on the current demand, color/markings, and genetics.

Breeding & Show Disclaimer

Our puppies (unless otherwise noted) are sold as “Pets” and are not guaranteed for either show or breeding purposes. We do not currently charge for breeding rights, however our Health Guarantee does NOT COVER puppies/dogs intended for breeding or show purposes unless a specific prior agreement is made.

Registration

Our puppies are Not registered unless otherwise noted. You may, at your expense, register them with AKC or CKC designer breed programs for show purposes, but be aware that our Health Guarantee only covers Pets unless special arrangements are made previously.

Limitation of Liability

The buyer agrees that Ohio Family Puppies, its owners, any employees, guardian homes in their breeding programs, and all their collective estate are released from all responsibility and liabilities for any damages, whether incidentally or consequentially caused by this dog, including, but not limited to, physical damage to property or any person(s).

The buyer of the puppy becomes fully liable for all costs associated with the puppy after it leaves our premises, including, but not limited to, boarding, vet bills, travel costs, food, medications, consequential or incidental damages, etc.

Important: If at any time, the buyer is no longer able or willing to care for the dog, they should contact us for assistance to find a new home.

General Store Policies

Mobile Terms of Service

The Ohio Family Puppies mobile message service (the "Service") is operated by Ohio Family Puppies (“Ohio Family Puppies”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Ohio Family Puppies' SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Ohio Family Puppies through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Ohio Family Puppies. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +1-855-643-6659 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Ohio Family Puppies mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain sensitive information relevant to your Purchase including, without limitation, your:

  • Email Address
  • First Name
  • Last Name
  • Physical Address
  • Phone Number
  • Credit Card Information

Data Use & Security

We do not sell any of your personal information, and its only used as necessary to market and facilitate our services to you. Your data is also fully secured with industry standard SSL encryption and spam bot protection measures. We process payments with Stripe, PayPal, Venmo, Google & Apple Pay, global industry leaders in secure online payments. Each of these companies have their own terms of use, security and privacy policies you agree to when you use any of their services, of which we are not responsible or liable for.

Mobile Text Message Marketing

  • Consent and Opt-In By subscribing to our text message marketing program, you agree to receive marketing messages from Ohio Family Puppies at the number provided. Message frequency may vary. Message and data rates may apply.
  • How to Opt-Out To opt-out of receiving text messages, reply “STOP” to any message you receive. You’ll be unsubscribed from our marketing program.
  • Support For support or assistance, reply “HELP” to any message or contact our support.
  • Privacy We respect your privacy. Your information will be used in accordance with our Privacy Policy.
  • Message Content Message content may include product offers, promotions, updates, and other marketing-related information.
  • Carriers We are not responsible for any charges or fees imposed by your mobile carrier in connection with our text message marketing program.
  • Termination We reserve the right to terminate our text message marketing program at any time, for any reason.

Product Returns

You have 30 calendar days to return an item from the date you received it. To be eligible for a return, your item must be unused and in the same condition that you received it.

Returns should be sent to our mailing address in Leesburg, Ohio (available upon request) and must include your original receipt or proof of purchase, the reason for returning, and your contact information.

Product Refunds

Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you on the status of your refund after inspecting the item.

If your return is approved, we will initiate a refund to your credit card (or original method of payment).

You will receive the credit within a certain amount of days, depending on your card issuer’s policies.

Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are nonrefundable.

If you receive a refund, the cost of return shipping will be deducted from your refund (If applicable).

Affiliate Products

Some products sold thru our online store, are affiliate products from Life’s Abundance, Nuvet, Baxter & Bella, Amazon, and/or other merchants.

We receive a small compensation from affiliate links used to purchase products or services. Your price will not be affected.

Affiliate Products Should Not Be Returned To Us And Are Not Eligible For A Refund From Ohio Family Puppies.

Instead, you should contact the appropriate retailer or merchant you purchased the product from, for their specific return and refund policies.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Ohio Family Puppies. Ohio Family Puppies has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.

You further acknowledge and agree that Ohio Family Puppies shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused, by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 (change this) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
